1. Agreement to Terms
These Terms & Conditions ("Terms") are a binding agreement between you and Emmanuel Shady Etika ("we", "us") governing your use of the Planet Positivemobile application (the "App"). By downloading, accessing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the App.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App. If you are under the age of majority where you live, you may use the App only with the involvement and consent of a parent or legal guardian.
3. Your Account
You agree to provide accurate information and to keep your account secure. You are responsible for activity that occurs under your account. Notify us promptly at support@planetpositive.app if you suspect unauthorized use.
4. License to Use the App
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial use, subject to these Terms. We reserve all rights not expressly granted.
5. Wellness Content — Not Medical or Professional Advice
Planet Positive offers emotional encouragement and inspiration. It is not a medical device and does not provide medical, psychological, therapeutic, counseling, or other professional advice, diagnosis, or treatment. The content is for general informational and motivational purposes only and is not a substitute for professional help.
If you are experiencing a medical or mental-health emergency, or are in crisis or having thoughts of self-harm, do not use the App — call your local emergency number or a qualified crisis line in your area immediately. Always seek the advice of a qualified health provider with any questions about a medical or mental-health condition.
6. Subscriptions and Payments
The core daily content is free. Planet Positive Plus is an optional auto-renewing subscription offering additional features. The following applies to subscriptions:
Payment is charged to your Apple App Store or Google Play account at confirmation of purchase.
Your subscription automatically renews for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period.
You can manage or cancel your subscription in your App Store or Google Play account settings; deleting the App does not cancel a subscription.
Prices may change; we will give notice as required, and changes will not apply to the period you have already paid for.
Except where required by law or by the applicable app store's policies, payments are non-refundable. Refund requests are handled by Apple or Google under their terms.
Any free trial automatically converts to a paid subscription unless canceled before the trial ends.
7. Acceptable Use
You agree not to:
Use the App for any unlawful purpose or in violation of these Terms.
Copy, modify, distribute, sell, or lease any part of the App, or reverse engineer or attempt to extract its source code, except where the law permits.
Interfere with or disrupt the App, or access it using automated means such as scrapers or bots.
Infringe the intellectual property or other rights of Emmanuel Shady Etika or others.
8. Intellectual Property
The App and its content — including stories, audio, text, graphics, logos, and the Planet Positive name and marks — are owned by Emmanuel Shady Etika or its licensors and are protected by intellectual property laws. Your license to use the App does not transfer any ownership to you.
9. Third-Party Services
The App may rely on or link to third-party services (such as sign-in, app stores, and analytics). We are not responsible for the content, policies, or practices of third parties, and your use of their services is governed by their terms.
10. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.
11. Limitation of Liability
To the maximum extent permitted by law, Emmanuel Shady Etika and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the App. To the extent liability cannot be excluded, our total liability is limited to the amount you paid us in the 12 months before the claim, or USD 50, whichever is greater. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
12. Indemnification
You agree to indemnify and hold Emmanuel Shady Etika harmless from claims, damages, and expenses arising out of your misuse of the App or your violation of these Terms or applicable law.
13. Termination
We may suspend or terminate your access to the App if you violate these Terms or to protect the App or other users. You may stop using the App and delete your account at any time. Terms that by their nature should survive termination will continue to apply.
14. Changes to the App and Terms
We may modify the App or these Terms. For material changes to these Terms, we will update the "Last updated" date and provide notice within the App. Your continued use after changes take effect means you accept the updated Terms.
15. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law rules. Nothing in these Terms limits any mandatory consumer-protection rights you have under the laws of your country of residence.
